Is there 15% withholding tax on US dividends?
Under the Treaty, a 15% withholding tax generally applies to U.S. dividends you receive from U.S. corporations. This will generally apply to dividends you receive on U.S. common and preferred shares.
Your “qualified” dividends may be taxed at 0% if your taxable income falls below $44,625 (if single or Married Filing Separately), $59,750 (if Head of Household), or $89,250 (if (Married Filing Jointly or qualifying widow/widower) (tax year 2023). Above those thresholds, the qualified dividend tax rate is 15%.
What do you pay? The U.S. withholding tax rate charged to foreign investors on U.S. dividends is 30%, but this amount is generally reduced to 15% for taxable Canadian investors by a tax treaty between the U.S. and Canada. 1 Source: MSCI, BlackRock, as of August 31, 2023.
All persons ('withholding agents') making US-source fixed, determinable, annual, or periodical (FDAP) payments to foreign persons generally must report and withhold 30% of the gross US-source FDAP payments, such as dividends, interest, royalties, etc.
The 15% WHT rate applies on the gross payment on interest, royalties, and certain lease payments to related parties resident in low-tax jurisdictions.

You may be able to avoid all income taxes on dividends if your income is low enough to qualify for zero capital gains if you invest in a Roth retirement account or buy dividend stocks in a tax-advantaged education account.
Certain nonresident aliens who are in the U.S. for more than 183 days will be subject to capital gains taxes. Nonresident aliens are subject to a dividend tax rate of 30% on dividends paid out by U.S. companies.
If you do not resolve the problem in time, the IRS guidance is to complete a US income tax return and request a refund. This will usually be a 1040NR [PDF] but may be the simplified 1040NR-EZ [PDF] if you meet certain conditions.
To be exempt from withholding, both of the following must be true: You owed no federal income tax in the prior tax year, and. You expect to owe no federal income tax in the current tax year.
Do you pay withholding tax on US shares?
If you want to buy US shares the US government will charge you a tax on any income you earn from those shares as you are not a US resident or citizen. Chances are you'd prefer to pay less of this tax (known as withholding tax) on your shares, which is where a W-8BEN form comes in.
Article 10(2)(b) of the UK and USA double taxation agreement allows for both countries to tax the dividends and limits Foreign Tax Credit Relief for dividends to a maximum of 15%.
Dividend withholding tax is the tax a company must take off a dividend before the payment is made to the shareholder. This is then passed onto the government in which the share is domiciled. The tax rate will depend on where the share is registered.
A payer must withhold 20% of an eligible rollover distribution unless the payee elected to have the distribution paid in a direct rollover to an eligible retirement plan, including an IRA. In the case of a payee who does not elect such a direct rollover, the payee cannot elect no withholding for the distribution.

First, holding U.S. dividend-paying stocks in TFSAs will lead to a 15-per-cent withholding tax on that dividend when received (either in cash or on a dividend reinvestment plan). This applies to common or preferred shares held directly or those held within managed products such as exchange-traded funds or mutual funds.
Dividends from stocks or funds are taxable income, whether you receive them or reinvest them. Qualified dividends are taxed at lower capital gains rates; unqualified dividends as ordinary income. Putting dividend-paying stocks in tax-advantaged accounts can help you avoid or delay the taxes due.
Investors pay taxes on the dividend the year it is announced, not the year they are paid the dividend.
All dividends paid to shareholders must be included on their gross income, but qualified dividends will get more favorable tax treatment. A qualified dividend is taxed at the capital gains tax rate, while ordinary dividends are taxed at standard federal income tax rates.

What type of dividends are not taxable?
Nontaxable dividends are dividends from a mutual fund or some other regulated investment company that are not subject to taxes. These funds are often not taxed because they invest in municipal or other tax-exempt securities.
If shares are held in a retirement account, stock dividends and stock splits are not taxed as they are earned. 1 Generally, in a nonretirement brokerage account, any income is taxable in the year it is received. This includes dividends, realized capital gains and interest.
However, no tax is deducted on the dividends paid to resident individuals, if the aggregate dividend distributed or likely to be distributed during the financial year does not exceed INR. 5000. A 10% TDS is payable on the dividend income amount over INR 5,000 during the fiscal year.
Withholding on payments of U.S. source income to foreign persons under IRC 1441 to 1443 (Form 1042) Generally, a foreign person is subject to U.S. tax on its U.S. source income. Most types of U.S. source income received by a foreign person are subject to U.S. tax of 30%.
